This SMS / Text Messaging Agreement ("Agreement") governs the use of SMS and text messaging services provided through 1smtg.com by Zero 1 Solution LLC ("Company," "we," "our," or "us").
By enabling or using SMS services, you ("User," "Broker") agree to the following:
1smtg.com may provide SMS/text messaging capabilities, including:
Loan status updates
Rate alerts
Appointment reminders
System notifications
Customer communication
Marketing or campaign messages (if enabled)
SMS services may be powered by third-party providers.
SMS messaging is an add-on service and:
Is not guaranteed for delivery, timing, or performance
May be delayed, blocked, or fail due to carrier or network issues
Depends on third-party providers
The Company is not responsible for undelivered or delayed messages.
You are solely responsible for:
All text messages sent through the platform
Message content and accuracy
Ensuring lawful use of SMS services
You agree that:
You have obtained prior express consent from recipients before sending SMS messages
You will comply with all applicable laws, including:
You must:
Honor opt-out requests (e.g., "STOP") immediately
Maintain records of consent where required
If you send marketing or promotional messages:
You must obtain explicit opt-in consent
You must provide a clear opt-out mechanism
You are responsible for all compliance obligations
The Company does not manage or verify your marketing consent.
Recipients must be able to:
Reply "STOP" to unsubscribe
Be removed from messaging lists promptly
Failure to honor opt-outs may result in account suspension.
SMS services rely on third-party telecom providers.
You acknowledge:
The Company does not control carrier delivery
The Company is not responsible for provider failures
Carrier fees or message rates may apply
You may NOT use SMS services to:
Send spam or unsolicited messages
Harass, mislead, or deceive recipients
Send messages without consent
Violate any laws or regulations
Phone numbers and message data are used only for platform functionality
We do not sell or share SMS data for marketing purposes
You agree:
All SMS-related risk remains with you
You will indemnify and hold harmless the Company from:
TCPA claims
Regulatory fines
Lawsuits related to messaging
The Company may:
Suspend SMS functionality
Restrict or terminate access
If misuse, complaints, or legal risk is detected
By enabling or using SMS services, you agree to this Agreement.
